1. Who we are

New Gen Patio designs and installs custom aluminum pergolas, covered patios and outdoor living spaces in Texas. Our contact details are at the end of these Terms.

2. Using the Site

You may use the Site for your personal, non-commercial use to learn about our services and contact us. You agree not to:

• submit false information, or information about another person without their permission;
• use the Site to send spam or unlawful, harmful or offensive content;
• try to gain unauthorized access to the Site, interfere with how it works, or scrape it with automated tools; or
• copy or reuse our content except as allowed in Section 8.

3. Quotes, estimates and pricing

Information on the Site, including descriptions, photos, prices, promotions, calculator results and any quote or estimate we send you, is for general information. Estimates depend on an on-site visit and on measurements, site conditions, materials, permits and homeowners association (HOA) requirements, and may change. A project only becomes binding when you and New Gen Patio sign a written contract. If anything on the Site conflicts with your signed contract, the contract controls.

4. Financing information

Financing information on the Site, including example terms, rates or monthly payments, is for reference only. It is not an offer or a commitment to lend. Any financing is subject to credit approval and to the terms provided to you in writing at that time.

5. Warranties and guarantees

Descriptions of our warranties and guarantees on the Site (for example our workmanship warranty) are summaries. Their full terms, conditions and exclusions are in your written contract or warranty document, which controls.

6. Text messages (SMS)

Program. When you check the text message consent box on one of our forms, you agree to receive text messages from New Gen Patio at the phone number you provide about your request, consultation scheduling and your project. We send promotional messages only if you separately agree to receive promotions and updates.

• Frequency: message frequency varies with your request and project.
• Cost: message and data rates may apply, according to your mobile plan.
• Opt out: reply STOP to any message to stop receiving texts. We will send one message to confirm, and then no more texts unless you sign up again.
• Help: reply HELP, or contact us at +1 346 581 9082 or info@newgenpatio.io.
• Not required: consent to receive text messages is not a condition of any purchase.
• Your number: you confirm that you are the subscriber of the phone number you give us, or that you are authorized to use it.
• Carriers: mobile carriers are not liable for delayed or undelivered messages.

We do not sell or share your text messaging opt-in or consent with third parties for their own marketing purposes. Our Privacy Policy explains how we handle your information.

7. Privacy and cookies

Our Privacy Policy and Cookie Policy explain what information we collect, how we use it and the choices you have.

8. Our content

The Site and its content, including text, photos, videos, designs, logos and the New Gen Patio name, belong to New Gen Patio or its licensors and are protected by law. You may view and share links to our pages, but you may not copy, modify or use our content for commercial purposes without our written permission.

9. Third-party sites and content

The Site may link to or show content from third parties (for example social media, maps, videos and reviews). We do not control them and are not responsible for their content or practices; their own terms and policies apply.

10. Disclaimer

We work to keep the Site accurate and available, but the Site is provided "as is" and "as available." To the extent allowed by law, we do not promise that it will always be accurate, complete, uninterrupted or free of errors. Photos show past projects and are examples; your project may look different.

11. Limitation of liability

To the extent allowed by law, New Gen Patio is not liable for indirect, incidental, special or consequential damages arising from your use of the Site. This section does not limit our obligations under a signed contract or any rights you have under laws that cannot be waived.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute about the Site or these Terms will be handled by the state or federal courts with jurisdiction in Texas.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top. Your continued use of the Site after a change means you accept the updated Terms.
